The cultural context, educational guidance, and support services are specifically designed for Korean nationals navigating the U.S. educational system.

4. Description of Services

Blue Bear Edutour LLC provides educational advising, program placement, and related operational support for students seeking educational opportunities in the United States. Services may include, without limitation, schooling placements, summer camp placements, study-abroad planning and execution, application and interview support, and post-placement local operations such as guardianship-style coordination, transportation coordination, and holiday support.

5. Parent/Guardian Authorization and User Responsibilities

Many of our services involve minor students. By submitting student information or requesting services, you represent that you are the student's parent, legal guardian, or otherwise authorized to act on the student's behalf.

Users of our services agree to:

  • Provide accurate and complete information when registering or submitting information
  • Promptly update us if submitted information changes
  • Use our services in compliance with all applicable laws and regulations
  • Follow institution/program policies and deadlines communicated during service delivery

6. Program Applications, Placements, and Third-Party Services

Blue Bear Edutour LLC assists clients with applications, placements, and operations, but does not guarantee acceptance, enrollment, scholarship outcomes, visa issuance, housing availability, travel availability, or specific educational outcomes. Final decisions are made by schools, camps, government authorities, transportation providers, and other third-party providers.

7. Fees, Payments, Cancellation, and Refunds

Fees for our services are specified in your applicable service agreement, proposal, invoice, or statement of work. Payment terms, cancellation terms, and refund terms are governed by those client-facing documents.

Unless otherwise expressly stated in writing, third-party pass-through costs (including but not limited to school/program fees, application fees, testing fees, travel costs, and third-party vendor charges) are non-refundable once incurred or committed.

8. Order of Precedence

If there is any conflict between these website Terms and a signed client agreement (including an MSA, service agreement, or statement of work), the signed client agreement controls for the covered services.

9. Intellectual Property

All content on the Blue Bear Edutour LLC website, including text, graphics, logos, and software, is the property of Blue Bear Edutour LLC or its content suppliers and is protected by international copyright laws.

10. Limitation of Liability

To the maximum extent permitted by law, Blue Bear Edutour LLC will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of our website or services.

To the maximum extent permitted by law, our total liability for claims arising out of the services will not exceed the amount you paid us for the specific service giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including but not limited to natural disasters, epidemics/pandemics, war, government actions, visa or immigration delays, school/program policy changes, transportation disruptions, or communication network failures.

12. Indemnification

You agree to indemnify and hold harmless Blue Bear Edutour LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of our services or violation of these Terms.

13. Modifications to Terms

Blue Bear Edutour LLC reserves the right to modify these Terms of Service at any time. Changes will be effective upon posting to the website. Your continued use of our services after such changes constitutes acceptance of the modified terms.

14. Governing Law

These Terms are governed by the laws of the State of Connecticut, without regard to conflict of law rules.

15. Dispute Resolution

15.1 Mandatory Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms, including the formation, interpretation, breach, or termination thereof, shall be referred to and finally determined by arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules. The place of arbitration shall be Connecticut, USA. The language to be used in the arbitral proceedings shall be English. Judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

15.2 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial.

15.3 Court Proceedings for Limited Purposes

Notwithstanding arbitration, either party may seek temporary or preliminary injunctive relief in a court of competent jurisdiction in Connecticut, and either party may seek court enforcement of an arbitration award.
